HAVA COMPLAINT

 

NEW July 24 -- End of secret ballot?

As predicted, Colorado's Secretary of State, Gigi Dennis, has used her extraordinary power to silence her critics.  Voting equipment certified by Colorado does not comply with the law.  It does not permit blind voters to verify their votes, and it requires voters to use ballots that are marked in a way that makes them not anonymous. 

 

Dennis refuses to enforce the law and does not want to hear any more about it.   In her response to critics, Dennis says that she , and she alone is the final arbiter on this matter and refuses to discuss the matter further.

 

July 14 -- Kolwicz asserts that the July 10th determination is unfair and incomplete.  Requests SOS to withdraw report and appoint neutral third party to resolve.

 

July 10 -- Secretary of State publishes HAVA complaint determination. 8 MB PDF document.

 

June 30 - Key government document altered
The certificate that authorizes Colorado use of the Hart InterCivic voting system has been altered.

Lawsuit charges Secretary of State and County Clerks

June 22 - Is Colorado evaluating alternatives for the eSlate?  Delay increases risk of 2006 Primary fiasco.

 

If eSlate decertified, here is an alternative. 

 

June 19 - Secretary of State Dennis was presented an alternative to the widespread use of non-compliant eSlate voting equipment.

 

Colorado's Secretary of State is violating laws designed to protect Open Records and Open Meetings.

 

Colorado's Secretary of State refuses to comply with the Colorado Open Records Act.

 

A formal HAVA complaint was filed on April 7, 2006 alleging wrongful certification of the HART eSlate digital ballot system.  The eSlate does not permit blind voters to verify their votes on the paper ballot, and does not allow anybody to vote anonymously. 

 

The Secretary of State refuses to permit the public to review key records and to observe meetings related to processing of the complaint. 

 

The Secretary of State has until July 10th, the day after paper ballots must be printed, to publish a finding.  To learn the status and progress of this complaint click State Issues.

 

Secret government meetings discovered

There is new evidence that the Colorado County Clerks Association has been conducting secret meetings.  The association has refused access to the public who wish to observe these meetings.   Participants, including Colorado's Secretary of State and County Clerks, are violating Colorado's Open Government (Sunshine) law.

Help America Vote Act

Provides $1.5 billion to help the States meet new standards.  Includes over $1.4 billion in direct assistance to the States for the improvement of administration, the buy-out of antiquated equipment, and new safeguards for voting rights. Also provides funding for programs to ensure disabled voter access and encourage youth to participate in the electoral process. Establishes a new Election Assistance Commission to oversee reform."

Based on centrally-counted, voter-verifiable, full-text paper ballots the declaration calls for results that are verifiable, auditable and provable.
 


SUMMIT COUNTY - DEMOCRATS RISK DISENFRANCHISEMENT

 

NEW July 20 - No ballots for Democrats.  
HART InterCivic printed the ballots for Summit County's upcoming Democratic and Republican Primary elections.  Problem is, they did not print any Democratic ballots.  Democratic absentee voters were mailed the Republican ballots and risk losing their vote if they do not return the Republican ballot to officials.  Does HART practice any quality control?

NEW July 19, 2006 - Harvie Branscomb, Eagle County Democratic Party Chair, pleads with Rep. Udall to change election rules to require paper ballots, true audits and bipartisan oversight.

 

BOULDER COUNTY - LAT FINDS PROBLEMS

 

NEW July 20 - Logic and Accuracy Test reveals major problems

June 23 - Elections coordinator reveals defect in Hart vote counting system.

 

Election coordinator, Josh Liss, today revealed that the Hart vote counting equipment does not perform according to its specifications - see Colorado Daily, June 23   This is the reason that the Clerk wants to use non-secret ballots.

Liss asked CAMBER to help the county to go forward with non-secret ballots.

 

CAMBER rejects the county's solution, and offers to help solve Hart's problem in a way that protects the secret ballot.

 

One must ask, why has this this clerk been working so hard to protect the equipment supplier rather than working to protect the people?

 

June 23 - Colorado Daily reports that Salas intends to choose non-secret ballot option.

Boulder County Clerk, Linda Salas, and Hart InterCivic are working to crush people's right to vote by secret ballot

The Boulder County Republicans and Dean Schooler are among those leading the fight to protect this basic right.

Boulder County election officials are out of control. 

  • They are abusing the power of their office to sacrifice basic voter rights.
     

  • They are fixated on doing what is most convenient for themselves rather than what is necessary for a trustworthy election.
     

  • They are working to cover up design and implementation deficiencies with the county's election procedures and the Hart vote counting equipment. 

Clerk Salas is a candidate in the upcoming primary election.  If ballots include a unique identifier, Salas can see how YOU voted.  This potential for intimidation must be stopped.

CAMBER believes that there is still time to act, today.  Get the Democratic Party to join the effort, and plead with the Secretary of State to protect secret ballots.

June 21 - Boulder County Republicans Urge County Clerk to Retain Secret Ballot

This is great news.  The Boulder County Republican Party has taken the lead to protect Boulder County voter's right to vote by secret ballot. They have asked the clerk to choose the secret ballot option.

Huge thanks to Rob McGuire, Chairman of the Boulder County Republicans.  We hope that the Democratic Party will soon join the Republican Party's cry for secret ballots.

June 19 - Boulder County now refuses to disclose its security plan.

 

Boulder County has refused to disclose its election security plan.  The plan exists.  The public has a right to verify that the plan is suitable.  We have objected.

 

After hundreds of reports of security problems with voting equipment and ID theft, it is imperative that the public have the opportunity to verify for itself that the plan is complete and workable.  It is no longer adequate to rely on government promises of security that have time and time again proven baseless.  

The security plan is required to include a contingency plan.  We believe that either (a) the security plan does not protect the election in the event that DRE voting equipment is decertified or fails, or (b) that the security plan properly requires early voting locations to stock paper ballots for every ballot style.  We want to verify that every county is required to stock paper ballots at early voting locations.

 

June 16 - Boulder County refuses to comply with the Colorado Open Records Act. 

 

Boulder County is illegally refusing to produce records.  These records might contain proof that the County is planning to break the law. 

 

Colorado's constitution prohibits the use of ballots that are marked in any way whereby a voter can be associated with their votes.  In the past, County Clerk Salas has forced voters to use such a ballot.

 

Boulder County is planning to award a "no-bid" contract for ballot printing to HART InterCivic on Tuesday, June 20th at the County Commissioners Meeting.
