Lease RFP - ACLU Declines Invitation

Dear Josh:

Thank you again for asking the Boulder County Chapter of the ACLU of Colorado to participate in the RPF Evaluation Team to consider the purchase of voting systems for the 2006 election.

However, after careful consideration and debate, the Boulder County ACLU Board of Directors voted last night to not accept this offer and to not participate in the RPF Evaluation Team. Our reasons:

First, As stated in the attached letter we sent to the County on January 4, 2006, the Boulder County ACLU's position is that, "No purchase of direct record electronic devices should be made at this time as virtually all existing electronic voting systems are associated with unacceptably high malfunction and error rates" and that, "the ACLU encourages Boulder County to seek a different method than the non-detachable, serialized bar code that can be traced to an individual voter." Our expectation is that the voting systems the team will be asked to evaluate in reponse to the RFP will not satisfy our concerns about accuracy, reliability, accessability and voter confidence.  

Second, the ACLU supports open government and opposes excessive government secrecy and confidentiality. The confidentiality agreement you have asked the ACLU to sign would preclude our Chapter board representative from disclosing any information about the work of the RPF Evaluation Team  to other Board members, our nearly 2,500 Boulder Couny ACLU members who we represent, or to the public. This is unacceptable to the ACLU, particularly given the fundamental voting rights issues involved that demand full and open public disclosure and participation.

We will be providing the County with a more detailed statement of our position in the next 30 days.

We appreciate being asked to participate. If you have questions or want further input from the ACLU in the next 30 days, please contact Boulder County Chapter board member Mariah Conroy, 303-938-1042 or myriah-conroy@quest.com who has been designated by the board to follow this issue while I will be out of town.
