Dear Mr. Kolwicz:

 

This letter is a response to your Open Records Request dated March 9, 2006.  The responses are listed in the same order in which you stated them in your letter.

 

1.     Regarding your request for a "list of the members, and their contact information." The committee members are as follows:

Josh Liss – Boulder County Elections Coordinator (Chair)

 

Marty Neilson – Chair of the Boulder County Republicans (Secretary)

 

Barbara Anuta – representing the Boulder County League of Women Voters

 

Deb Gardner – Acting Chair of the Boulder County Democrats

 

Faith Gross – representing the Legal Center for People with Disabilities and Older People

 

Time Hansford – Business Analyst for the County Clerk & Recorder

 

Mike Harlan – Boulder County Information Technology Manager

 

Jana Petersen – Clerk to the Board of County Commissioners

 

Bo Shaffer – Chair of the Boulder County Libertarians

 

Nancy Jo Wurl – Chief Deputy Clerk & Recorder

 

3.     The next committee meeting is scheduled for March 15, 2006 at 9:00 a.m.  The committee will meet again on March 22 at 9:00 a.m.  Additionally committee meetings have not yet been scheduled.

 

4.     At the last committee meeting, Josh Liss was elected as Chairman of the committee.

 

3.     As you are aware, the committee is composed of members of the County.  The committee is charged with evaluation of the RFP using the criteria set forth in the RFP itself.  The committee will make a recommendation to the Clerk who will then decide whether to forward the recommendation to the Board of County Commissioners for a decision.  At that time, the Board will hold a public meeting/hearing during which members of the public can attend and may be afforded the opportunity to speak.  The committee is not operating under any specific rules or by-laws:  it as an ad hoc committee not formally constituted by the County governing body.

 

4.     You requested "Non-confidential information regarding the HART Intercivic bid."  As you know the Open Records Act provides that "trade secrets, privileged information, and confidential commercial, [and] financial . . . data furnished by or obtained from any person"  is not discloseable. C.R.S. 24-72-204(3)(a)(IV).

 

Additionally, pursuant to County Policy II.14.F(4b and 4c), C.R.S.  24-103-203(4), all RFP responses are confidential until the contract award, at which time you may receive copies of all proposals with the exception of trade secrets contained therein. (See also the RFP provision in the RFP that was issued regarding disclosure once a contract is awarded)  This applies to the responses from the two companies that declined to bid as well.
