HAVA complaint against HART eSlate certification

In answer to your question about “the process by which this HAVA complaint will be investigated, evaluated, and decided”, the process is established and governed by (1) section 1-1.5-105, C.R.S., entitled “Complaint Procedure”, Rule 31 of the Secretary of State’s Election Rules, entitled “Rules Concerning Help America Vote Act, Title III: Administrative Complaint Procedures”, and (3) section 402 of HAVA, entitled “Establishment of State-based administrative complaint procedures to remedy grievances”.
My staff, my attorney, and I need an opportunity to review and analyze your complaint in light of all of the above requirements in order to determine the appropriate next step. The difficulty and complexity of this determination is increased by such factors as: (1) your complaint is both a HAVA and non-HAVA complaint, (2) you allege multiple violations of federal law, the state constitution, and state statutory law, and (3) your complaint involves other state and federal laws not specifically mentioned in your complaint, such as state statutes and rules governing the process and standards of certification of voting equipment.
During this initial period of review and analysis, I would appreciate an opportunity to consult separately with my staff and my attorney. I believe that this is reasonable and necessary, and should not subject me accusations of “lack of transparency into the Secretary of State’s office”.
I take my responsibilities seriously and intend to exercise them to the best of my ability.
