HAVA complaint against HART eSlate certification

Dear Ms. Dennis:
It has been three weeks since the May 24th Public Hearing regarding HAVA Complaint SOS-HAVA 01-06-0001.
We have not been contacted by the Secretary of State’s office. We have found no updated information on the SOS website.
Therefore, we are requesting the following nine items under the Colorado Open Records Act:
1. SOS plan/schedule for processing of the complaint. 2. Reports of the status of the investigation. 3. Copy of the communication from EAC to the Colorado Secretary of State regarding the decision to require Vote-PAD certification, as testified to by Mr. Gardner. 4. SOS reasoning that voting on the eSlate VVPAT is anonymous or that the law does not require it to be anonymous. 5. SOS reasoning that blind voters can verify the votes printed by the VVPAT or that the law does not require this. 6. SOS discovery regarding testing by the Secretary of State. 7. SOS discovery regarding preferential treatment of electronic ballots over paper ballots. 8. SOS plan for identification and selection of alternatives (we have agreed to participate). 9. We have searched the SOS website, but have not found copies of the written materials that were submitted regarding the complaint.
We do not require personal copies of these materials and will be very happy to download the information from the Secretary of State website. Many members of the public are interested in obtaining this information and it would be a valuable service to the community for the SOS to publish these materials on the site.
If paper is the only medium. We ask that you tell us the cost in advance of incurring any chargeable expense.
