Boulder County refuses to release records

Jun 19 - CAMBER criticizes superficial and inadequate acceptance test plan.  Recommends Commissioners reject the plan.

Jun 19 - Boulder County now refuses to disclose its security plan.  The plan exists and is required to include a contingency plan. 

 

Jun 16 - CAMBER demands that documents be produced.

 

Jun 16 - County refuses to respond to ballot plan request.

 

Jun 15 - County Commissioners postponed the plan to award HART a no-compete contract for ballot printing.  It appears that HART neglected to submit a cost estimate.  It is likely that the Commissioners will be asked to purchase non-anonymous ballots.  This is why CAMBER wants the ballot plan.  The Commissioners meeting is being planned for Tuesday, June 20th.

 

Jun 14 - CAMBER seeks security plan and acceptance testing plan.

 

Jun 13 - CAMBER seeks ballot plans  through Colorado Open Records Act.

 

Jun 12 - CAMBER to SOS Dennis.  Conspiracy?  We have a right to know if Boulder County will provide anonymous ballots.

 

May 26 - CAMBER to Secretary of State Dennis.  Retransmitting our May 18th appeal.  Will Boulder County use anonymous ballots?

 

May 19 -- State's response is unintelligible.  Request for clear statement and Boulder County confirmation that ballots will no longer be marked with identifying marks.

 

May 18 - A complaint has been filed against Boulder County for refusing to disclose whether 2006 ballots will be anonymous.  Refusal to respond gives the appearance that the County is working to block timely legal action against their illegal use of marked ballots.

Committee member withdraws name from report.

One of the Proposal Evaluation Committee members, Marty Neilson, has requested that her name be removed from the committee report.  CAMBER has requested a revised copy of the report that reflects this change.


CAMBER asks voting equipment committee to reconsider report

CAMBER has reviewed the Boulder County RFP Evaluation report and we are appalled.

  1. The committee has failed in its duty to report these facts about the HART InterCivic proposal:
     
    • It does not comply with the RFP requirements
    • It violates Colorado law 
       
  2. The committee wrongly recommends changing the RFP terms after the bids have been submitted.  This stinks to high heaven.  The county will be accused of rigging the bid. 

    The RFP is for a lease not a sale, and there is no mention that lease costs would be credited against a future purchase. 

    Disclosure of these two deal sweeteners would likely have attracted additional bid responders and cost the county less. Adopting them would substantially
    rig any future purchase in HART's favor.
     
  1. Details in the report are wrong (hopefully innocently).  It is absolutely not true, for example, that the HART system is “the most universally accessible certified system available at this time”.  AutoMark is more accessible, is certified nationally and by most states (not Colorado), and is available at this time. 

    AutoMark was suspiciously denied Colorado certification.  HART’s equipment suffers from the identical problem used by the Secretary of State to deny AutoMark certification.

CAMBER asks evaluation committee to "reject the HART proposal".

 

HART proposes digital ballots.  The people want paper ballots.

 

Check these facts:

  1. Some states choose "paper only"
     

  2. Digital ballot equipment is not working
     

  3. Boulder County Clerk pushes for unpopular digital ballots
     

  4. AutoMark Federally certified, preferred by disabled voters.


Boulder County received only one proposal in response to its Voting Equipment Lease RFP.  The county has not released any information about the proposal other than it is from HART/InterCivic.

The clerk appointed a hand picked Proposal Evaluation Committee.  On March 9, CAMBER submitted an Open Records Request to learn about the committee. 

 

March 13, CAMBER submitted a letter to the committee members to learn about the beneficiaries, the committee, and the March 15 demonstration.

 

March 20, CAMBER recommended for committee to reject the HART proposal.

 

In January, more than 200 people responded to the clerk's invitation to comment.  (This is a large document.)  Only one or two of the respondents were supportive of the Salas plan.  The remainder object to digital ballots and want paper ballots.
