HAVA Complaint and violations of Colorado Open Records Act and "Sunshine" laws

 

July 24 -- Secretary of State denies Kolwicz request for third party arbiter, refuses to include key documents in the record, and declares the matter closed.

 

July 14 -- Kolwicz asserts that the July 10th determination is unfair and incomplete.  Requests SOS to withdraw report and appoint neutral third party to resolve.

 

July 10 -- Secretary of State publishes HAVA complaint determination. 8 MB PDF document.

 

June 22 - Request Secretary of State to act on 8-point alternative.

 

June 19 -- Anticipating a whitewash, after observing the foot-dragging in the Secretary of State’s office, this morning we submitted our 8-point alternative to the widespread use of non-compliant DRE voting equipment for the 2006 primary election.

 

June 16 -- CAMBER charges Secretary of State is violating  Colorado Sunshine Law.  Demands access to records and correction to false information.

 

June 16 -- Secretary of State denies access to records.

 

June 13 -- CAMBER seeks HAVA complaint status through Colorado Open Records Act.

 

June  1 -- Holly Lowder is Colorado's new Elections Director.  She just resigned from her job as Alamosa County County Clerk and Recorder where she was appointed in 1981.  Alamosa County has fewer than 7,000 active voters.  Click to read our welcome letter.
 

May 30 -- Kolwicz submits 21 documents plus an index to supplement the HAVA complaint record.  Many inquiries remain unanswered.

 

May 26 -- Is it true that the Vote-PAD requires federal certification?

Until June 1st, additional written materials may be submitted to Wayne Munster (Wayne.Munster@SOS.state.co.us) at the Secretary of State's offices.  The Secretary of State will make a decision on or before July 10, 2006. 

 

May 19 -- Secretary of State says no test records exist.

 

May 17 -- Discussion regarding insufficiency of records response.

 

May 13 -- SOS will respond to records request.  The CORA request.

 

May 12 -- SOS agrees to present an overview of the state certification process and requirements at the May 24th hearing

 

May 10 -- Request that SOS provide necessary hearing data and hearing preparation.  Colorado Open Records Act request submitted.

 

May 09 -- Boulder County approves contract to lease for one year  219 eSlate machines for $1,688,425.  The county acknowledged that the eSlate certification is the subject of a formal HAVA complaint.

 

May 09 -- SOS responds that there will be no hearing preparation, and no two way communication.

 

May 08 -- Request for hearing data and meeting to establish hearing procedures.

 

May 03 -- Secretary of State acknowledges complaint and schedules hearing for May 24, 2006, 1:30 p.m.

 

Apr 22 --  Request for hearting on the record.  TO: Secretary of State, "Should the Secretary of State intend to rule against our HAVA complaint (in other words to permit use of the HART eSlate equipment), we request a hearing on the record."

 

Apr 20 -- On April 17th, Eagle County signed a contract to purchase the faulty HART equipment.  There is no apparent sense of urgency to resolve the HAVA complaint that should disallow use of the HART eSlate equipment.

 

Apr 10 -- The Secretary of State has not yet replied to an urgent HAVA complaint.  A follow up letter has been sent.
