Lesbian and Gay Rights
Washington State NOW supports protection from
discrimination for lesbians and gays, and opposes attacks on granting equal
rights for lesbians and gays.
In most parts of Washington State lesbians and gays:
-
can be fired from their job regardless of job performance if their sexual
orientation becomes known.
-
can be evicted from their apartment or home regardless of their ability
to pay rent.
-
can lose custody of their children regardless of their parenting ability.
-
can be fined or imprisoned in 25 states and the District of Columbia because
of archaic laws criminalizing private consensual sexual activity among
adults. Although these laws criminalize heterosexual activities as well,
they have been arbitrarily enforced only against homosexuals.
The ability to work, live, and raise one'’s own children are basic human
rights, not special rights. In the past, NOW has supported bills which
would protect lesbians and gays from discrimination. Lesbians and gays
are the target of violence, harassment, ostracism and discrimination in
all areas of their lives. In addition, women and men mistaken for lesbians
and gays are also subject to discrimination. The public does not support
discriminatory Initiatives, as shown by the inability of Initiatives 608,
610, 166, and 167 to gather enough signatures over the past few years.
Attempt to Ban Lesbians and Gays From Being Adoptive or Foster Parents
Washington State NOW opposes any attempt to
ban lesbians, gays, and single people from becoming adoptive or foster
parents. Banning lesbians and gays from becoming foster or adoptive parents
hurts the children who don'’t get adopted or who wo'n’t have a foster parent
to go to when their home situation is abusive or unsafe. The impact will
be to deny children homes. All people who wish to adopt or be foster parents
must meet the standard of being fit parents as well as what is in the best
interest of the child. Being adopted is better than a life of foster care.
Having a foster home is better than remaining in a dangerous, abusive home.
This bill will hurt the children who are most in need of loving, caring
homes. In addition, preventing single people from adopting or being foster
parents also discriminates against people who have homes, love, and resources
to provide to needy children. Marriage alone does not automatically make
two people fit to adopt or be foster parents. NOW opposes both restrictions
on adoptions and foster care by lesbians and gays and by single people.
Attempts to Ban Same-Sex Marriages
Washington State NOW opposes any attempt to
legalize discrimination against gays and lesbians by banning same-sex marriages.
Attacks on same-sex marriage have become the leading anti-lesbian and
gay strategy. Despite a recent study showing 71% of lesbians are in committed
relationships, same-sex marriage is not legal in any state. Nevertheless,
radical extremists are using this issue to divide the country and target
lesbians and gay men for discrimination. Organized opposition to this attempt
to legalize discrimination is essential.

The US Supreme Court has declared marriage a fundamental right under the
constitution.

Without the legal right to marry, same-sex couples do not have rights like
family health coverage, medical and bereavement leave, child custody, tax
benefits and pension plans.

Tradition can'’t justify discriminating. Not long ago, marriage was traditionally
limited to members of the same race and religion, and married women were
virtually the legal property of their husbands.

Civil and religious marriage are two separate institutions, Civil marriage
binds a couple in a legal contract consisting of obligations and benefits.

Legalizing same-sex civil marriage will not require any religion to legalize
or recognize these marriages.

The rights that married people take for granted, such as the ability to
make medical decisions for an incapacitated spouse, are denied to committed
lesbian and gay couples.
Lesbians and gays are the targets of violence, harassment, ostracism and
discrimination in all areas of their lives. NOW has supported bills which
would protect lesbians and gays from discrimination. The public does not
support discrimination against lesbians and gays. In the last few years
four anti-gay initiatives have failed to gather the needed signatures.
